The Superior Court of California, County of Sacramento, is seeking qualified attorneys or firms to represent conservators and proposed conservators under Probate Code sections 1470 and 1471 - external link. Counsel is appointed to represent parties upon the court's determination. Court calendars for conservatorship cases occur weekly on Tuesday, Wednesday, and Thursday at 9:00 a.m. and 1:30 p.m., and trials are typically held on Monday at 8:30 a.m. and 1:30 p.m. or on Friday at 1:30 p.m.

Qualifications

  1. Attorney and Firm Qualifications
    a. Attorneys must have an active membership in good standing with the California State Bar or registration as a legal aid attorney qualified to practice law in California under California Rules of Court, rule 9.45 - external link.
    b. Firms must have an attorney who is individually qualified under California Rules of Court 7.1103 (a) - external link and agrees to work in close professional consultation with an attorney who does not yet meet the experience-based qualifications of California Rules of Court, rule 7.1103(b) - external link.
  2. Have no professional discipline imposed in the 12 months immediately preceding the execution of the application for appointment to the panel.
  3. Covered by professional liability insurance with limits no lower than $100,000 per claim and $300,000 per year, or covered against professional liability at a level not lower than the aforementioned amounts.

Compensation

If the court determines that there is no ability to pay from the estate of the conservatee, the rate for counsel is $86.59 per hour paid by the County of Sacramento, Office of Conflict Criminal Defenders.
